Terms and Conditions of Use

These terms and conditions of use for the “Fantasy: A Once and Future Genre” website (URL: https://fantasy.bnf.fr/en) hereinafter “the Site,” define the terms of use of the Site.
 
By navigating within the Site, users (hereinafter “Users” or “the User”) indicate that they have read and agreed to the terms and conditions of use (hereinafter “the Terms”). The applicable Terms are those available on line on the Site on the day of Users’ connection to it.
 

The BnF reserves the right to modify the Terms at any time in order to adapt them to mandatory legal changes or to new features on the Site that may be proposed to Users, by publishing a new version of the Terms on the Site. The date of the latest update of these Terms is indicated in the first line of the Terms themselves.

 

1. Purpose

The purpose of these Terms is to establish and regulate the ways in which users can use the Site.

 

2. Terms and Conditions of Use of the Site

The Site makes a set of digital documents from the BnF and its partner institutions, as well as their description text, available online to Users.
In addition, Users have the possibility of:
- downloading certain documents or excerpts from them.
- pointing out technical or bibliographic problems or mistakes.
- following hypertext links to other BnF websites and to those of the BnF’s partner institutions and business partners, knowing that those sites will have their own Terms and Conditions of Use, and that it is the User’s responsibility to find out about and follow those Terms and Conditions.
- Contact the Site’s administrators.

- Play the “Kingdom of Istyald” video game, with no registration necessary.

Users can also access a mobile version of the Site.

 

3. Conditions of Access to the Site

Using the Site requires an internet connection, preferably high-speed.
It is stipulated that the connection is the User’s responsibility, not the BnF’s.
Users may navigate the Site via a personal computer or any other connected device (tablet, smartphone, etc.) that enables internet access.

 

4. Terms and Conditions of Use of the Site’s Contents

 

4.1 Digital Documents Available on the Site

The digital documents on the Site may be protected by intellectual-property rights.

The different components of the Kingdom of Istyald video game – including, most notably, both its software components and its audiovisual content – are, in particular, protected by intellectual-property rights.  

Therefore, Users agree not to reuse the digital documents or the video game, except in cases specifically set out in these Terms, without both prior approval from the BnF and having obtained authorization from the various rights-holders concerned.

 

4.2 Descriptive Metadata

In order to reuse the descriptive metadata related to the documents referenced on the Site, users agree to refer to and follow the rules of the institution where the documents the metadata relates to come from.

Descriptive metadata produced by the BnF is managed by the “Etalab” open license. The most current version of Etalab can be found at the following address: https://www.etalab.gouv.fr/wp-content/uploads/2017/04/ETALAB-Licence-Ouverte-v2.0.pdf. Etalab descriptive metadata can be used freely by everyone, as long as they mention the source of the information (“Bibliothèque nationale de France”) and the date of the most recent update.

 

5. Users’ Promises and Responsibility

While on the Site, users promise not to contravene legislative regulations in effect or these Terms. Users are informed that any and all violations of the aforementioned regulations and Terms can lead to judicial proceedings and sanctions against them.

Users duly note that if they use the Site in a way that violates these Terms or applicable rules and regulations in general, the BnF reserves the right to block Users’ access to the Site immediately and without warning.

As a general rule, the BnF can not be held responsible if Users use the Site in ways that are not in accordance with the Terms.

 

6. Personal Data and Cookies

 

6.1 Personal data collected on the site directly from users

In order to use certain features of the Site, Users’ personal data can be collected by the BnF.

To learn more about how your personal data is processed on the Site, and about your rights therein, please read the Site’s privacy policy.

 

6.2 Data collected indirectly from users of the site (“Cookies”)

To find out about the trackers or “cookies” related to the BnF Site, and your rights therein, please consult our privacy policy.

 

7. Intellectual Property Rights

 

7.1 Intellectual-property rights pertaining to the Site

The BnF holds all intellectual-property rights pertaining to the Site.
In accordance with articles L. 341-1 à L. 343-7 of the French Intellectual Property Code, the BnF holds, most notably, all rights pertaining to its status as producer of the database that comprises the Site.  
Users agree not to use the Site in any way that would constitute a violation or an infringement of applicable French laws and regulations.

 

7.2 Intellectual-property rights pertaining to the brands and logos

The BnF owns the brand names “Bibliothèque nationale de France” and “BnF”, as well as their respective logos that appear on the Site.            
The abovementioned brands have been registered at the INPI by the BnF and may not be used without the BnF’s express written prior consent.
Any total or partial usage or apposition of those verbal, semi-figurative or figurative brands without express written prior consent will contravene article L. 716-1 of the Intellectual Property Code.

 

7.3 Intellectual-property rights pertaining to the contents of the Site

Certain contents of the Site (texts, images, sounds, and other documents) are subject to intellectual-property rights.
Consequently, reuse of those contents is regulated and subject to prior written consent from the owners of the rights pertaining to the content, unless said reuse falls within the boundaries of exceptions to copyright established in Article L. 122-5 of the Intellectual Property Code.

 

8. Governing Law - Disputes

The Site and the present Terms and Conditions of Use are subject to French law. In case of dispute, French courts have jurisdiction.

In the event of conflict or inconsistency between the French and English versions of this contract, or of a challenge about the meaning of any of the terms or provisions included herein, the French version shall prevail.

The information gathered from that e-mail (the User’s e-mail address, and, where required, their first and last name) will be subject to personal-data processing by and for the BnF. The processing’s purpose is to manage the “Fantasy: A Once and Future Genre” Site’s Users’ questions, comments and requests. The information will be kept long enough to process the question, comment, or request only, except when keeping it longer is required in order to manage a potential legal dispute.

In accordance with regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), you have the right to access any data that concerns you. You also have the right to correct, restrict, or erase that data.
